1. Acceptance of These Terms

These Terms of Use ("Terms") govern your access to and use of the website at mydreamappliances.com (the "Site"), operated by DreamHome Appliance Group ("DreamHome Appliance Group", "we", "us", or "our"). By accessing or using the Site, you agree to these Terms and to our Privacy Policy and Cookie Policy, which are incorporated here by reference. If you do not agree, please do not use the Site.

2. Who We Are

DreamHome Appliance Group operates two showrooms:

The Site presents the appliance and related product lines we represent, information about our showrooms, and ways to reach us.

3. The Site Is Informational and Is Not an Offer

The Site is a marketing and informational resource only. It does not conclude any transaction. Nothing on the Site is an offer to sell, and no content on the Site creates a binding commitment by us to provide any product or service on any particular terms.

Product descriptions, specifications, images, features, and availability are provided for general information, come in part from the manufacturers of the product lines we represent, and are subject to change or discontinuation at any time without notice. We do not warrant that any of this information is complete, current, or error free. Manufacturer specifications and availability control over any information shown on the Site.

4. Purchases Happen Elsewhere

The Site does not process orders. If you choose to acquire a product, you may reach a separate storefront through a clearly labeled link. Any purchase you make there is a separate transaction governed by that storefront's own terms and policies, and not by these Terms. We are not responsible for the content, terms, or practices of that separate storefront, and your dealings with it are solely between you and the operator of that storefront.

The Site may contain links to third-party websites, including manufacturer sites and the separate storefront described above. We provide these links for convenience only. We do not control and are not responsible for the content, products, policies, or practices of any third-party website. Following a link is at your own risk, and the terms and privacy practices of the destination site will apply to your use of it.

6. Intellectual Property in Site Content

The Site and its content, including text, layout, graphics, photographs we own or license, and the selection and arrangement of that content, are owned by DreamHome Appliance Group or its licensors and are protected by copyright and other laws. We grant you a limited, personal, non-exclusive, non-transferable, and revocable permission to view and use the Site for your own informational and non-commercial purposes. You may not copy, reproduce, republish, distribute, modify, or create derivative works from Site content without our prior written permission, except as allowed by applicable law.

7. Third-Party Trademarks

The Site displays the names, logos, and marks of the brands and product lines we represent, including names such as Sub-Zero, Wolf, Cove, Thermador, SKS, and many others. All such names, logos, and marks are the property of their respective owners. We display them only to identify the product lines we carry. This use is nominative and for identification only. It does not imply that any brand owner sponsors, endorses, is affiliated with, or is otherwise connected to DreamHome Appliance Group. All rights in those marks remain with their respective owners.

The SKS brand is also known by its earlier name. SKS is a brand of LG Electronics USA, Inc., which operates it as Signature Kitchen Suite; both names refer to the same product line.

8. Acceptable Use

When using the Site, you agree not to:

  1. Use the Site for any unlawful purpose or in violation of these Terms.
  2. Attempt to gain unauthorized access to the Site, its servers, or any connected systems.
  3. Interfere with or disrupt the Site or the networks or systems that support it.
  4. Introduce viruses, malware, or other harmful code.
  5. Use any automated means to scrape, harvest, or collect data from the Site without our written permission.
  6. Copy or misuse Site content in violation of Section 6.

9. No Warranties

The Site and all information on it are provided "as is" and "as available", without warranties of any kind, whether express or implied. To the fullest extent allowed by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error free, or that product information and specifications shown on the Site are accurate, complete, or current. Product specifications and availability are set by the manufacturers and are subject to change as described in Section 3.

10. Limitation of Liability

To the fullest extent allowed by law, DreamHome Appliance Group and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Site or your reliance on any information on the Site. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you. Nothing in these Terms limits any liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold harmless DreamHome Appliance Group and its owners, officers, employees, and agents from any claims, losses, and reasonable expenses, including reasonable attorney fees, arising out of your misuse of the Site or your violation of these Terms or of any law or the rights of a third party. This section applies to the extent allowed by law and does not apply to matters caused by our own conduct.

12. Privacy

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which explain what information we collect and how we handle it. Please review them.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Subject to any rights you have under applicable law, you agree that the state and federal courts located in Placer County, California, or the Sacramento, California area will have jurisdiction over any dispute arising out of or relating to these Terms or the Site. We each agree to try in good faith to resolve any dispute informally before starting a formal proceeding. Nothing in this section limits any right you may have to bring a matter before a small claims court or a government agency.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will change the "last updated" date above. Your continued use of the Site after we post an update means you accept the revised Terms. Please review this page periodically.

15. Severability and Entire Agreement

If any part of these Terms is found unenforceable, the rest will remain in effect. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and us regarding your use of the Site.
